You may request an upgrade mode of transportation for your order (air freight). If you specify a air freight, you will be billed for the entire amount of freight. C.Alaska, Hawaii and Puerto Rico orders are shipped F.O.B. our warehouse. DAMAGED SHIPMENTS/SHORTAGES: SIGN only for the number of packages received. Indicate DAMAGED when you sign for the material. KEEP the shipping carton. HOLD the goods. NOTIFY us by TOLL FREE phone for instructions. Any DAMAGED goods or SHORTAGES MUST be reported within 10 DAYS of date of invoice. PRODUCT OVERAGES/SHORTAGES: IF A PRODUCT IS MISSING, OR IF AN EXTRA PRODUCT IS INCLUDED (BUT NOT ORDERED), PLEASE CONTACT CUSTOMER SERVICE. MERCHANDISE RETURNS: No returns on discontinued product. All sales final on discontinued and closeout items. RETURNED CHECKS AND REFUSED SHIPMENTS: All returned checks, refunds and refused shipments will result in a $25.00 processing charge. WARRANTY (DEFINITIONS) “Drag Specialties” - as used herein, the term “Drag Specialties” shall mean Drag Specialties, Division of LeMans Corporation. “Goods” - As used herein, “Goods” shall mean only those motorcycle parts, acc essories, articles or clothing and personal effects distributed by Drag Specialties. “Customer” - As used herein, “Customer” shall mean retail purchasers of Goods. LIMITED WARRANTY: Goods distributed by Drag Specialties are warranted only to the extent of the original manufacturer’s warranties and Drag Specialties shall have no obligation with respect to any claims or obligations arising as a result of any such warranties. Improper Care or Misuse: Drag Specialties shall have no obligation hereunder in the event the Goods have been modified by any other person or organization, or where the Goods become defective in whole or in part as a result of improper installation, improper maintenance, improper use, abnormal operation or any other misuse or mistreatment of the Goods. Proof of Purchase: Drag Specialties shall have no obligation hereunder in the event the Customer is unable to present a receipt evidencing the date on which the Customer purchased the Goods. Exhaust: Exhaust systems are warranted for manufacturing defects only. However, there is no warranty on exhaust pipes and mufflers with regard to any discoloration. Discoloration (bluing) is caused by tuning characteristics, exhaust timing, carburetor jetting, overheating, etc. and is not caused by defective manufacturing. Disclaimers of Warranties: The warranties contained herein are expressly in lieu of any other expressed or implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, or any other obligations on the part of Drag Specialties. Any models, drawings, plans, affirmations of fact, promises or other communications by Drag Specialties with reference to the performance of the Goods are solely for the convenience of the Customer and shall not in any way modify the expressed warranties and disclaimers set forth herein. The Customer acknowledges purchasing the Goods solely on the basis of the commitments of Drag Specialties as expressly set forth herein. No agent or other party is authorized to make any warranties on behalf of Drag Specialties, or to assume for Drag Specialties any other liability in connection with the Goods. Consequential Damages: Drag Specialties shall not be liable for any consequential or incidental damages arising from the breach of any warranties, the failure to deliver, delay in delivery, delivery in non-conforming condition, or for any other breach of contract or duty between Drag Specialties and the Customer. Limitation of Actions: Any action resulting from the breach of any warranty contained herein by Drag Specialties must be commenced in one (1) year after the cause of action is accrued. In no event shall Drag Specialties’ total liability for any or all breaches exceed the purchase price of the Goods. HAZARDOUS MATERIALS UPS charges an additional Hazardous Materials charge of $51.00 per ground package requiring shipping papers under 49 C.F.R. Section 172.200. Any hazardous materials charges are the dealers’ responsibility. SUBSTITUTIONS AND PRODUCT CHANGES: From time to time, some of our catalog items are discontinued or not available. When this occurs, we reserve the right to substitute an item of equal or better quality. We also reserve the right to discontinue any product(s) at such time as considered necessary. Drag Specialties also retains the right to make changes in design, construction or specifications of the products we distribute at any time without incurring any obligation in incorporating such changes in products previously sold. These terms shall govern all our sales, and may not be changed except with our written consent.
